The NAACP has initiated legal action against xAI and its subsidiary MZX Tech, claiming they operate unpermitted methane gas turbines at the Colossus 2 data center in South Memphis. This lawsuit highlights significant legal and environmental concerns surrounding the operations of the Elon Musk-founded AI company, now owned .
According to the complaint, xAI is utilizing 27 gas turbines without the necessary air permits, directly violating the Clean Air Act. The emissions from these turbines pose serious health risks, including respiratory diseases and cancers, particularly alarming due to the site’s proximity to residential areas.
In advance of the lawsuit, the NAACP issued a 60-day intent to sue notice, but xAI’s lack of response prompted the legal move. The case is seeking not only a halt to the turbine operations but also financial penalties for the alleged violations of federal law.
Ben Grillot, a Senior Attorney for the Southern Environmental Law Center, emphasized the need for accountability. He stated that the ongoing operations without permits are not only illegal but also detrimental to the well-being of local families, who have raised concerns over the potential health impacts of near.
