AI Disruption Hits Legal System with Increased Filings and Risks of Inaccuracy

But the integration of AI tools like ChatGPT has introduced a new dynamic, enabling a broader range of users to engage in legal processes.

Research indicates that this issue is escalating, with a significant rise in the number of filings featuring AI-generated content. In a study of U.S. federal courts, the percentage of civil cases filed -represented individuals surged from 11% to approximately 18% after the introduction of generative AI. The analysis of 1,600 filings noted an increase in AI-generated text from virtually none to nearly 18% within a year.

While judges are currently managing the influx, they face growing pressure that could overwhelm the system. Increased back-and-forth between parties has led to an estimated 158% rise in filings for judges to review. Experts warn that without proper regulations, the legal system’s ability to function efficiently may come under severe strain, necessitating urgent consideration of AI’s role in legal proceedings.
